Substances constituting a hazard to water must be classified in water hazard classes according to their level of hazardousness or as not hazardous to water. The classification procedure is detailed in the Administrative Regulation on the Classification of Substances Hazardous to Waters. The German government is currently drafting a new ordinance which will update the classification procedure.

Regulatory Framework for substances hazardous to water

Operators intending to handle a substance or a mixture in a facility are legally obligated by the Administrative Regulation on the Classification of Substances Hazardous to Waters (Verwaltungsvorschrift wassergefährdender Stoffe (VwVwS) to allocate said substance or mixture to a water hazard class (WGK).  

The VwVwS of May 17th, 1999 comprises 4 Annexes:

  • Annex 1: List of substances identified as non hazardous to water in 1999
  • Annex 2: List of substances allocated to WGK 1, WGK 2 or WGK 3 in 1999
  • Annex 3: Classification criteria for substances.
  • Annex 4: Classification criteria for mixtures.

The amendment of July, 27th 2005 of the VwVwS comprises an amended Annex 1 and Annex 2.
